In this research paper, Dyna Tuytel and Patrick Dyke review the history and purposes of common-law liability for property damage. They examine several statutes limiting liability, focussing on those capping liability for environmental disasters, such as oil spills and nuclear accidents. They present and critique the rationales for such statutes. Liability limits, they conclude, subsidize environmentally harmful activities and encourage risky behaviour.
